This policy describes how the operator of the Marathon Beneva de Montréal, Courons Montréal (“we” or “us“), collects, processes, uses and shares personal information and personal data about visitors to the websites we operate (the “Websites“) and people who register for events we organize (the “Events“). The use of the second person (“you“, “your“, “yours“) refers to a visitor to the Websites or a participant in an Event, as the context requires.

In this Privacy Policy, Personal Data means information about an identifiable individual.

In the event of a discrepancy between the English and French texts of this policy or in the event of a dispute, the French text shall apply.

In summary

We collect and use personal data primarily in two ways:

  • When participants register for our Events and provide us with contact or other information about themselves, we primarily use this data to process the registration and provide our services. We also use contact information and general attendee characteristics (e.g., email address, phone number, age group) to promote our Events more effectively, including through the creation of targeted audiences, where attendees have not asked us not to do so.
  • We collect certain data about participants during the Events to operate the Events and to ensure the safety of all participants.
  • When people visit our Websites, we collect tracking information in an industry-standard manner in order to analyze traffic to our Websites and to create customized audiences for advertisements. We also use contact information from visitors who voluntarily sign up for our communications (such as our newsletters).

We only share your personal data with those who need to have access to it for the purposes described above, including certain companies that provide services to us. We ensure that your data is treated appropriately and confidentially.

If you have created an account with one of our suppliers and have given your consent to the processing of your personal data directly to that supplier as part of your registration for an Event, you should refer to the privacy practices of that supplier.

2. WHAT ARE THE GROUNDS FOR OUR DATA PROCESSING?

  • We need to process certain personal data in order to be able to provide you with services, receive payments and fulfill our obligations to you.
  • We process certain personal data with your consent. This consent is sometimes implied where permitted by law.
  • We process personal data about users located in the European Economic Area based on our legitimate interests and those of our affiliates and partners, where such processing respects the fundamental rights of those users and their reasonable expectations of privacy. Processing based on legitimate interests never involves systematic individual tracking.

3.2. INFORMATION COLLECTED AUTOMATICALLY DURING THE EVENT

We collect the following data through our suppliers when you participate in an Event.

Your timing data will be made public and associated with your name, age and gender through our timing partner.

Chip timing data

We collect data from electronic chips embedded in the bibs used during the Event. 

Fixed devices allow us to know when you pass certain locations, such as the start, finish, intermediate timing locations and certain areas on the Event grounds.

The chips do not allow us to know where you are at all times.

Location data about an identifiable individual is used solely for the purposes of Event security and Event timing.

Certain data collected in an aggregated and anonymous manner from the chips allows us to improve the logistics and organization of the Events, including by analyzing the movements of participants in an aggregated manner.

3.3. HOW DO WE USE DATA ABOUT AN EVENT?

We use the personal data that is collected in the course of organizing the Events for the purposes that are described below.

3.3.1. Communicating with you

We use the personal information you provide to us (such as your name and email address) to communicate with you about Events you have registered for.

3.3.2. Organization and operation of the Events

We use the personal information collected as part of an Event registration and during the Event to organize the Event and to provide you with the services we have agreed to provide. 

3.3.3. Ensuring safety during the Events

An identifier placed on a chip embedded on your bib allows event staff to access your profile with a reader to ensure your safety in case of injury or health problems. The tracking of split times from the chips also allows for the identification of situations where the security of certain participants is at risk and to make the appropriate checks. Event staff do not systematically check the participant’s profile from the chips.

3.3.4. Commercial communications

If you consent to receive marketing communications from us, we use the personal information you provide (such as your name and email address) to send commercial communications about our company, other Events we host, our products, and promotions. We may send commercial communications from our sponsors. In some cases, your consent may be implied or implied, but you can always withdraw it. We comply with all applicable regulations regarding junk mail. If you no longer wish to receive electronic communications from us, you may notify us at any time by writing to us at info@mtlmarathon.com.   

3.3.5. Personalized marketing

We personalize our advertising campaigns based on certain data collected from our Events, such as your subscription to our newsletter, the Events you have attended, and your age group. This data allows us to target audiences to advertising service partners. Some targeted advertising campaigns may be conducted on behalf of our sponsors.

This data is not associated with you personally and is provided to us in aggregate form. 4.1.4. Data from social networks

We may collect information from social networking sites or applications (Facebook, LinkedIn, X, YouTube, Google+, etc.) when you interact with profiles we operate on those social networking sites or applications. These sites or applications are also governed by their own policies regarding your personal data, which may be different from ours and may be applicable.

4.1.5. Monitoring technologies

We use cookies and other tracking technologies to improve the performance of the Websites, to personalize your experience on the Websites, and to serve ads to targeted audiences. You can control the storage of cookies from your browser. Unless you have provided us with information about yourself from your mobile device or computer, cookies do not allow us to identify you. Some browser cookies come from our suppliers and they may be able to associate some of the data collected through cookies with other data they have about you. 4.2.3. Maintenance and security of the Websites 

We use data gathered through the Websites and data from analytical tools to monitor user usage of the Websites generally, to prevent abusive use of the Websites, to identify problems or bugs in the Websites, and to determine what features need to be improved. We may use certain automatically collected data to ensure the security of the Websites and our computer systems, for example, to prevent misuse or to prevent or deter fraud.

4.2.5. Personalized marketing

This data allows us to target audiences to partners who provide advertising services. Some advertising campaigns may be conducted on behalf of our sponsors. 

 

5. HOW DO WE STORE YOUR DATA?

We retain the personal data collected until you request that we destroy it, or until our business no longer requires it. We do not, however, make a commitment to retain personal data collected for a specific period of time after an Event.

Personal data collected is stored electronically by our service providers on servers located in Canada.

Some data is processed by our service providers using facilities that may be located in jurisdictions other than Canada. See section 7.2 for more details.

Data generated from Google Analytics is stored on servers controlled by Google. 

 

6. HOW IS YOUR DATA PROTECTED?

Your personal data is hosted on servers operated by our service providers and is protected by security measures commensurate with the sensitivity of the data against unauthorized disclosure, modification and use. Your financial data is subject to security measures by our service providers that comply with the standards imposed by the payment card networks.

Our employees and suppliers are made aware of the confidentiality of personal data that is collected through the Websites and in connection with the Events and are made aware of appropriate security measures to prevent unauthorized access to personal data.

 

7. WHO HAS ACCESS TO YOUR DATA?

We will only share your personal data in the ways described in this policy and where we have obtained your consent. Your personal data may be shared with the categories of persons described below for the purposes that are identified.

7.1. EMPLOYEES

Collected personal data is only available to our officers and employees who must access it for the purposes described in this policy.

7.2. OUR SERVICE PROVIDERS

We share certain personal data with service providers that enable us to provide our services more efficiently. We obtain confidentiality undertakings from these service providers with respect to the personal data provided to them and processed by them for us. In some cases, these suppliers may process data for their own purposes as described below.

Solutions MedEventYour name, date of birth, telephone and e-mail contact information, as well as the information submitted for your emergency contacts are stored for a period of 30 days in our databases in order to identify you and document any medical or security incidents that may affect you during the event. This information can only be accessed by medical professionals or security managers when creating, modifying or consulting emergency call cards, medical intervention reports or security intervention reports.
In compliance with the archiving rules governing the provision of medical services, only the nominative data of participants who have requested medical or security services, and for whom documentation has been collated, will be kept for a period of 7 years, except in the case of an order to safeguard data as part of a coroner’s inquest, for example.

7.3. OUR SPONSORS

Some of our sponsors may benefit indirectly from the personal data we collect in the course of targeted advertising campaigns. We never share your data with our sponsors directly. We do offer some of our business partners the ability to target a personalized audience based on data we have in our possession, in a manner similar to what online advertising service providers such as Google and Facebook do.

7.4. OUR LEGAL OBLIGATIONS

We may also disclose personal data collected to third parties if expressly permitted or required to do so by applicable law, or if we are compelled to do so by a competent authority. We may disclose personal data in connection with legal proceedings if necessary to protect our rights or those of our users.

7.5. TRANSFER OF OUR COMPANY

In the event that the sale or restructuring of all or part of our business is contemplated, we may share the personal data we collect with the persons or organizations involved before and after the transaction, regardless of whether the transaction goes through. In such a case, these persons or organizations agree to keep the personal data collected confidential and to use it only for the purpose of evaluating the feasibility or advisability of the transaction and in accordance with this policy.

 

8. WHAT ARE YOUR RIGHTS WITH RESPECT TO YOUR PERSONAL DATA?

If you have created an account directly with one of our suppliers, they may process your personal data in accordance with the consent you have provided and you should contact that company directly with respect to such processing.

8.1. ACCESSING YOUR DATA

You can view and change certain personal information we hold about you through your Race Roster account. You may also send us a written request at info@mtlmarathon.com.

We will respond to your request promptly (within 30 days of receipt).

8.2. WITHDRAWING YOUR CONSENT OR OBJECTION

Your browser allows you to withdraw your consent to certain processing of your personal data, including by preventing the storage of browser cookies. Other tools are available to control the data that is collected through the Websites.

If you wish to withdraw your consent to the processing of your personal data beyond what is permitted by the Websites or your browser, please notify us by writing to info@mtlmarathon.com. You may also object to the processing of your personal data on the basis of our legitimate interests. It is not possible to prevent any processing of your personal data and continue to use the Websites and participate in Events. The only way to stop the processing of your personal data is to stop using the Websites and not to participate in Events.

8.3. REQUESTING THE DELETION OF PERSONAL DATA 

You may request the deletion of the personal data we hold about you where it is not necessary for us to retain it. To make such a request, please email us at info@mtlmarathon.com. We will comply with your request as soon as possible (but no later than 30 days after receipt).

If you continue to visit the Websites or participate in an Event, we will collect certain data about you again.

8.4. LODGING A COMPLAINT 

Our company is governed by the laws and regulations applicable in Québec and Canada and is subject to the jurisdiction of the Québec and Canadian privacy authorities. 

The legislation or regulations applicable in your jurisdiction of residence may allow you to address a supervisory authority having jurisdiction. Otherwise, any complaint or claim based on this policy or our processing of your personal data should be addressed to the Québec or Canadian authorities.

8.5. VERIFICATIONS

We may verify the identity of individuals seeking access to their personal data. Any information collected for this verification will not be used for any other purpose.

 

9. AMENDMENTS TO THE POLICY 

We may amend this policy from time to time to reflect changes in our personal data management practices. In the event that a change is made, the new policy will be available on our website at : https://mtlmarathon.com/en/privacy-policy/.

If we have collected your contact information, we will notify you of any material changes to our privacy policy by email within a reasonable period of time before the new policy takes effect. If we process your personal data on the basis of your consent, we will not process it further on the basis of your consent.
